Why would you need an attorney for a truck accident claim?

On Behalf of McHenry Haszard Law | Sep 5, 2017 | Truck Accidents

If you’ve been involved in a crash with a truck, you may want to know if having an attorney is necessary. You can always call the insurance company and work out a settlement on your own, right?

That’s true, but it can be a bad idea. Some insurance companies will make a low settlement offer just to resolve the situation, even though it’s not an amount that is fair to you. For that reason, having an attorney negotiate for you can end up winning you even more compensation than you expected.

You may also want to consult an attorney if you could be partially at fault for the accident. You can normally still sue for a portion of compensation, even if you were partially at fault for a crash. For example, if you are found 40 percent at fault, you should be able to receive 60 percent of the compensation you would have received compared to the 100 percent of compensation you’d receive if you weren’t at fault at all.

Your attorney can also help you decide who the responsible parties are and assist you in suing each one. Sometimes, there is more than one responsible party. For example, if the manufacturer of the truck made a design error, the driver made an error and the mechanics made an error, all three could be liable for your injuries.

Personal injury cases may seem simple, but they can have complicated negotiations and other factors to consider. Your attorney can handle these details while you focus on recovering from your injuries and getting back to your life.
